TERMS AND CONDITIONS

  1. Price
The quoted price will be held for a period of one calendar month from the date of quotation. However, quotations for overseas programs will be subject to adjustment in respect of increased costs (if any) arising from fluctuations in the rate of exchange of the Australian dollar and any relevant overseas currency.
  1. Acceptance of quotation
This quotation may only be accepted in writing, by an official order and subject to these terms and conditions.
  1. Payment
Payment shall be made on the following terms:(a)  25% of the quoted total figure upon acceptance of this proposal,(b)  Balance to be paid in full 14 days prior to time of proposed program.
  1. Cancellation
Cancellation of numbers must be made at least 10 weeks prior to program starting.  Failure to do so will incur total cost.  Southern Exposure reserves the right to bill the client and the client must agree to pay on demand any costs incurred in respect of any cancellation of any production at any stage.  Cancellation of number less than the minimum numbers specified will alter the quotation price accordingly.
  1. Agents
The client hereby appoints Southern Exposure as its agent in relation to any specialist services required, not already supplied by Southern Exposure, in the production of the quoted task and accepts liability for all monies due to the same in respect for the services provided.
  1. Payment of Costs
Any costs required to be paid by the client pursuant to clauses 5, 6, and 7 hereof shall be payable on demand. In the event of non-payment (and without limiting the rights of Southern Exposure to sue therefore) the client shall pay Southern Exposure interest on the amount of the costs due and unpaid at the rate of 25% per annum.
  1. Covenant and Indemnity
  • The client warrants and covenants with Southern Exposure that nothing it shall require Southern Exposure to do or perform personate to this engagement shall;
  • Infringe any copyright
  • Affect any person’s rights to privacy, or
  • Defame any person.
  • In consideration of Southern Exposure accepting any order based upon this quotation the client hereby indemnifies and forever holds Southern Exposure harmless for all action, suits, applications, demands, costs, damages or losses of any description whatsoever arising from any breach of the covenants given under clause 7(a) hereof.
  1. In applying to participate in this Southern Exposure program (“the Event”):
 I ACKNOWLEDGE that there are inherent dangers associated with this activity and my participation in theactivity, and that serious accidents can and sometimes happen which may result in me being injured.I DECLARE that I am medically and physically fit and free from impairment and able to participate in theEvent.To the full extent permitted by law, I agree to ABSOLVE AND INDEMNIFY Southern Exposure, its directors, officers and employees from and against any and all liability for injury, loss or damage however caused arising out of my participation in the Event.I agree to RELEASE AND FOREVER DISCHARGE Southern Exposure from all claims that I may have or may have had but for this release arising from my participation in the Event.I AUTHORISE Southern Exposure to arrange medical or hospital treatment (including, without limitation, ambulance transportation) if I am not available to do so and I INDEMNIFY Southern Exposure for all costs associated therewith.I AGREE that Southern Exposure retains the right to utilise images of my participation in the Event for the purposes of promotingSouthern Exposure programs and events.I have read, understood, acknowledge and agree to the above declaration including the warning, release andindemnity. Indemnity DeclarationI agree to abide by the following conditions:(a) I acknowledge that my child/organized group/myself will be exposed to all normal risks associated with participation in this course;(b) I agree that I will indemnify Southern Exposure Eco-Adventure Sports, Surf Coast Shire, Great Ocean Road Coast Committee, Barwon Coast Committee, Parks Victoria, Dept. Education, Colac Otway Shire, City of Greater Geelong, Barwon Water, Department of Sustainability and Environment, Minister for the Environment, Minister for Climate Change, Minister for Planning, Minister for Ports, Melbourne Water, Director of National Parks, Surf Life Saving Victoria and  Apollo Bay Foreshore Committee.Cancellation PolicyAll classes will be conducted at their scheduled time unless weather conditions warrant otherwise. Southern Exposure reserves the right to cancel any class if we feel conditions are too dangerous. A credit of 10% can be applied towards a future lesson, class, etc. upon rescheduling due to unsafe conditions.Please note: we require at least 6 registered people, for the activities to go ahead.Exceptions to this policy cannot be made for any reason. We run an extremely high quality, tight margin program, with limited space.General public or one on one sessions - If you must cancel your reservation, our policy is as follows:1) All lessons require a MC/Visa Credit Card to secure your spot.2) Should conditions be unfavourable on the day of your lesson, your lesson will be rescheduled. We will make all efforts to reschedule your lesson. Due to peak season demand there is a slight chance we may not be able to reschedule.3) For group lessons, all cancellations and rescheduling on your part must be made at least 72 hours prior to the start time of your lesson. Cancellations and rescheduling made within 72 hours of the lesson will be charged a $25 cancellation/rescheduling fee per participant. If you cancel within 24 hours of scheduled lesson time, you will be charged 80% of lesson cost.4) Participants that fail to show will be charged in full for the lesson, no exceptions.5) Private lessons must be cancelled or rescheduled on your part at least 7 days prior to the scheduled lesson to avoid being charged.6) All Cancellations must be confirmed with Southern Exposure staff; no voice mail messages, or e-mails will be accepted.7) Southern Exposure is not responsible for expenses incurred in preparation for a cancelled trip, such as airline tickets, or for costs incurred due to travel delays, flight cancellation or illness.8)  Students (clients) must provide a signed Southern Exposure Participant Declaration Form the day of the service or Southern Exposure instructors reserve the right NOT to teach potential students (clients). Students (clients) will not be entitled to any refunds and/or classes, if they do not sign and bring liability form(s).If you have any questions regarding our cancellation policy, please call our office for a detailed explanation.
